In case the (re)construction works are planned in the project, should Beneficiary/partners be owners of the land and buildings?

 

When structuring your project, please take into account the following provisions of the Guidelines for Grant Applicants:

  • Chapter 2.2.2: a pre-feasibility study must be provided for the actions, in which the total amount in Budget Heading 3 “Equipment and Supplies” and Budget Heading 6 “Works (Infrastructure)” equals or exceeds 50.000 EUR (each of these headings or the sum of the total amounts of these headings).
    The information in the pre-feasibility study should also contain the information on the ownership or right of use of the relevant land/buildings as well as their further use.

  • Chapter 2.5.1.2: a set of technical documentation for works/ investments requested under national legislation in order to implement the planned works/ investments in the action (i.e. technical project, environment impact assessment, building permission, etc) must be provided to the Joint Technical Secretariat within 3 months after the approval of the action. These documents must also include ownership or right of use evidence documents.

  • Chapter 2.5.19: the Beneficiary and partners shall provide access to the information regarding the action as well as access to the sites where the action was implemented to the JMA/JTS, EU authorised bodies and the external auditor authorised by the JMA to carry out respective verifications. These inspections may take place up to sever years after the payment of the balance to the Beneficiary.
    This means that the results of the action should be retained at least for 7 years.

During the quality assessment of the action with respect to (re)construction activities, the assessors will check whether the planned investments are justified, necessary for the action and feasible, i.e. that the applicant/partner will be able and have an authority to implement the planned investments, and that they are durable, i.e. how the financial, institutional sustainability will be ensured after the end of the action.
